Increasingly, large corporate entities are leveraging the threat of lawsuit against small businesses and independent entities in the name of protecting their intellectual property. In many cases, the larger organization seeks to restrict speech protected by the Fair Use defense, or protect a property right it simply does not hold. However, even for the most specious of claims, and where the claim constitutes a grave abuse of the civil process, the limited resources of the independent, especially when contrasted with the near-infinite resources of a large corporation, force the smaller entity to buckle to the demands of the larger entity. We believe that such activity makes a mockery of the intellectual property and civil justice systems. Therefore, the Fair Use Defense Fund exists to assist those who find themselves being unjustly bullied in this manner.
